Newport Beach Vacation Property Management by Groundswell-Terms and Conditions

  1. Reservations between June 1 and September 10 are weekly from Saturday to Saturday only.  The Unit will be available for occupancy on the check-in date at the check-in time set forth in the Reservation. Guest will vacate the Unit by the check-out time on the check-out date.
  2. All amounts are due as set forth in the Reservation.
  3. A security deposit will be required to cover charges incurred or damages during your stay.
    1. The security deposit will be returned to Guest within thirty days of the check-out date if
      1. the property is returned to Groundswell in the same condition received, normal wear and tear excepted
      2. Only minor cleaning, including sanitizing bathroom and kitchen areas is necessary, i.e., all trash removed from the unit, all dishes washed and put away, all floors vacuumed or swept, all doors and windows closed and locked. Any excessive cleaning charges will be billed to the Guest,
      3. All keys have been returned to Manager and there are no missing or damaged items pursuant to the inventory taken upon occupancy and upon check-out,
      4. The electricity bill does not contain abusive charges,
      5. No fees are payable to the cable or telephone company, and
      6. No fines are payable to the City of Newport Beach for the time of Guest’s occupancy.
    2. Manager can be available at the time of check-out to inspect the property with Guest.
  4. Since this Unit is taken off the market upon receipt of Guest’s deposit, no refunds will be made for this reservation unless, and only to the extent that, the Unit is re-rented for the same period at a comparable rate.
  5. Guest agrees to abide by the following limitations on the use of the Unit:
    1. Pursuant to the City of Newport Beach licenses, the Unit may be occupied by no more than the Maximum occupancy. All reservations are to families and responsible adults only. No high school, college or civic groups, chaperoned or not, are permitted without express written permission from Manager. Violation is grounds for immediate termination. Guest acknowledges that he/she will personally occupy the Unit for the entire reservation period and will not sublet any portion of the Unit.
    2. No pets are allowed.
    3. No smoking on the premises.
  6. Pillows, blankets, bedspreads, linens and towels are provided. The kitchen is stocked with pots, pans, utensils, plates, bowls, glassware. A light cleaning of the premises is available mid –week at an extra cost. PLEASE BE SURE ALL OF THE ABOVE ARE IN THE CORRECT UNIT OR YOU WILL BE CHARGED FOR MISSING ITEMS.
  7. Service requests will be responded to as quickly as possible, subject to Guest providing adequate access to the Unit.
  8. Guest is expected to care for the property as if it were their own. Guest acknowledges that unless Manager is notified on day of check-in of any damage or cleaning concerns, then thereafter, all damages or concerns regarding the premises during the occupancy will be Guest’s responsibility and must be reported to Manager and paid prior to departure. REARRANGING OF FURNITURE IS NOT PERMITTED AND ANY COST OF PLACING FURNITURE BACK IN ITS ORIGINAL POSITIONS WILL BE CHARGED TO GUEST.
  9. In the event Manager is unable to deliver the premises to Guest under this Agreement prior to occupancy due to fire, eminent domain, double booking, acts of God, Guest agrees that their sole remedy will be a full refund of all consideration previous paid by Guest.
  10. Neither Manager nor owner will have any responsibility for lost, stolen or abandoned items.
  11. Guest agrees to release and indemnify Manager and the owner from and against all liability should anyone be injured on the premises during the time of the occupancy, resulting from any cause whatsoever.
  12. Manager will have all remedies available under local law if Guest fails to check-out timely.
  13. Manager is not responsible for any injury to persons or property or any theft of money, jewelry or other valuables in connection with this occupancy.
